Rappaport, Hertz, Cherson & Rosenthal, P.C. is comprised of twenty attorneys representing a multitude of clients in a broad range of areas with a concentration in the fields of landlord-tenant-lawyer, Civil Litigation, Banking and Real Estate. We have associates with expertise in mortgage loan transactions, real estate transactions, Supreme Court and appellate court litigation, including loan foreclosures, Administrative Proceedings, Cooperative and Condominium Conversions and Housing Court litigation.

We represent Landlords ranging from the owners/managers of large multi-building complexes to as small as the owner of a one or two family house or a single apartment in a cooperative or condominium in various aspects of Housing Court Litigation. Our attorneys have expertise dealing with non-payment proceedings, holdovers based on lease violation or nuisance, non-primary residence or illegal sublet, licensee proceedings and squatter proceedings, lease expiration holdovers and claims of succession rights. We also have expertise in dealing with litigation in the HP part of the Court, including 7-A proceedings, heat and hot water cases and comprehensive proceedings.

We have long term experience and expertise in handling matters before the Division Of Housing And Community Renewal including rent overcharge matters, claims that an apartment should be subject to Rent Control or Rent Stabilization, Fair Market Rent Appeals, Reduced Services complaints, High Income Deregulation and Certificates Of Eviction.

We are familiar with all aspects of Section 8 regulations and have assisted clients in obtaining monies that Section 8 has improperly failed to forward to them.

The firm has been very successful in Appellate Litigation, both as the Appellant and the Appellee.

Our litigation department has handled contract actions, mortgage foreclosure actions for major lenders, “Yellowstone Injunctions”, Plenary Actions for rents due from Commercial Tenants and their guarantors, Article 78 and Article 81 proceedings. They also defended tort claims and Federal Civil Rights proceedings.

We have been representing Emigrant Funding Corporation (part of Emigrant Savings Bank), M & T, HSBC, Wells Fargo, and various mortgage brokers for the closing of both residential and commercial loans for some time. We currently have four attorneys and several para-legals working in our closing department.

In addition to our bank representation, we have drafted condominium and cooperative conversion plans, initiated foreclosure proceedings, and represented many clients in the financing and re-financing of commercial, residential and cooperative properties. This representation includes single-family homes, cooperative apartments, condominiums, multi-family, mixed use and commercial buildings. We have also represented clients with regard to construction loans. We are counsel for a number of cooperative corporations handling the refinance of underlying mortgages, transfer agent duties and various other cooperative matters.

The firm is actively involved with the Bronx-Manhattan Board of Realtors.
